COPYRIGHT, USAGE RIGHTS & CONSENT AGREEMENT

1. COPYRIGHT & USAGE RIGHTS OF PHOTOGRAPHS:  On purchasing a photo session and included digital files you accept that Katy Rogers Photography grants you a non-exclusive perpetual personal-use license to download and/or copy the accompanying digital Photographs subject to the following restrictions:
   1. This license is for Personal Use Only. Personal use means non-commercial use of the photographs for display on personal websites and computers, or making image prints or video copies for personal use. The Photographs may not be used in any way whatsoever in which you charge money, collect fees, or receive any form of remuneration or recognition. The Photographs may not be used in competitions, advertising, be re-edited, re-sold, re-licensed, or sub-licensed.
   2. Should this licence condition be breached and any Photograph supplied by Katy Rogers Photography is re-edited or tampered with by the Client in any way whatsoever, under no circumstances are these files to be published online, in print or by any other means. They are not to be credited to Katy Rogers Photography. No responsibility will be taken by Katy Rogers Photography for files edited by any third party.
   3. Express prior permission from Katy Rogers Photography may be requested under exceptional circumstances. Should permission be granted conditions will apply.
   4. Title and ownership, and all rights now and in the future, of and for the Photographs remain exclusively with Katy Rogers Photography.
   5. There are no warranties, express or implied. The Photographs are provided ‘as is.’
   6. Katy Rogers Photography will not be liable for any third party claims or incidental, consequential or other damages arising out of this license or buyer’s use of the Photographs.
2. CONSENT: The Client consents that the photographs taken and presented by this photographer may be used by Katy Rogers Photography for the purpose of display, portfolio, advertising, website or any publication, directory or forum; printed or online; to promote the services, name or business of Katy Rogers Photography. The Client also agrees that the images taken by Katy Rogers Photography can be used without additional compensation to them; the Client. If the Client does not consent to this item, Katy Rogers Photography must be notified in writing before the shoot. All respect will be given to the Clients’ expressed request to non-consent.
